1. Definitions
- "Provider", "we", "us": the operator of chesscheats.com.
- "Service": the chesscheats.com website, the Atlas / Chesscheats Software, related dashboards, APIs, license-key infrastructure, Discord-linked features, and any optional add-ons (proxy, burner-mail) provided under a paid plan.
- "Software": the desktop application(s) (Atlas Chess Bot, Atlas Overlay, Burner Mail extension) made available for download under your active plan.
- "Customer", "you": the natural or legal person accepting these Terms.
- "Plan": any subscription or one-time purchase tier offered by the Provider (Overlay, Starter, Pro, Pro Yearly, Lifetime, or future tiers).
- "Intended Scope": the use cases described in Section 5 (chess.com bots, Trainer, Lessons, Puzzles, personal analysis).
- "Third-Party Platform": any platform the Software may interact with, in particular chess.com, on which the Provider has no control.
2. The Service
The Service consists of (i) downloadable Software for Windows, (ii) a license-management dashboard, (iii) optional residential-proxy provisioning, and (iv) optional disposable-email and chess.com account-creation tooling, depending on the Plan you have purchased. Provisioning of digital components begins within minutes after payment is confirmed.
The Service is intended for use as a chess study, practice and analysis tool against chess.com's built-in bot library and within the chess.com Trainer, Lessons and Puzzles features (the Intended Scope, Section 5). The Service is not designed, marketed, or sold for use against human opponents in ranked or unrated play.
3. Eligibility & Account
You may only use the Service if you:
- are at least 18 years old (or the age of majority in your jurisdiction, whichever is higher);
- have full legal capacity to enter into a binding contract;
- are not located in, established in, or a resident of any country subject to a comprehensive trade embargo by the EU or the United Nations;
- have not previously been suspended or removed from the Service.
You are responsible for keeping your login credentials and license key confidential, and for any activity that occurs through your account.
4. License Grant
Subject to your continued compliance with these Terms and full payment of any applicable Fees, the Provider grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Software on a single device per license key, exclusively for your personal, non-commercial use within the Intended Scope.
The ATLAS bot is locked to a hardware identifier (HWID) on first activation. The optional BurnerMail browser extension uses an IP-address whitelist with a hard cap of three (3) distinct IPs per key, intended to cover personal use across locations such as home, school, and a spare device on the same account. You may reset both locks from the dashboard at any time; the Provider reserves the right to throttle or block resets that are used to circumvent the one-device-per-key restriction.
You may not, and may not permit any third party to:
- copy, modify, translate, decompile, disassemble or reverse-engineer the Software, except to the extent expressly permitted by mandatory law that overrides this restriction;
- rent, lease, lend, sell, redistribute, sublicense, or commercially exploit the Software or any part of the Service;
- circumvent, disable, or otherwise interfere with security or license-enforcement features;
- use the Service to develop a competing product;
- remove, obscure or alter any proprietary notices on the Software.
5. Acceptable Use & Intended Scope
The Service is licensed for use within the following Intended Scope:
- Practice and study against chess.com's built-in bot library (Komodo, Maia, Mittens, Hikaru-bot and similar non-human opponents);
- The chess.com Trainer, Lessons and Puzzles features, as a personal study aid;
- Personal analysis and review of your own archived games;
- Engine play against another local engine for research, content creation, or educational purposes.
Outside Scope. Use of the Software against human opponents in any chess.com format (rated, unrated, tournament, arena, or otherwise) is outside the Intended Scope. Where the Software is technically capable of such use, the Provider does not endorse it and does not represent that the Software is safe, lawful, or compliant with the chess.com Fair Play Policy in such contexts. Any decision to use the Software outside the Intended Scope is made solely by you, at your own risk, and on your own responsibility.
You agree, at all times, not to use the Service to:
- violate any applicable law or regulation, including export controls and sanctions;
- engage in fraud, money-laundering, or any criminal activity;
- distribute malware or attempt to compromise other systems;
- infringe any third party's intellectual-property, privacy or publicity rights;
- operate more than one license key on the same device or share your license key with others;
- resell, sub-licence, or otherwise commercialise the Service or any part of it;
- misrepresent your relationship with the Provider.
The Responsible Use page (/responsible-use) is incorporated by reference into these Terms and forms part of the Acceptable Use Policy.
6. Customer Representations & Warranties
By using the Service, you represent and warrant that:
- you have read, understood and accepted these Terms, the Privacy Policy, and the Responsible Use page;
- you are aware that engine assistance during human play is prohibited by the chess.com Fair Play Policy and that any decision to engage in such use is yours alone;
- you accept all risk arising from your interaction with chess.com or any other Third-Party Platform, including without limitation account suspension, ELO loss, removal of titles, removal of paid memberships, withholding of prize money, and reputational consequences;
- any payment instrument you use is yours and you have authority to use it;
- any account or chess.com username you submit, or that we provision for you, is used in accordance with your obligations to chess.com and applicable law;
- you will not use the Service in a manner that exposes the Provider to third-party liability.
7. Indemnification
You agree to defend, indemnify and hold harmless the Provider, its successors, affiliates, owners, directors, employees, contractors and agents (collectively, the "Indemnified Parties") from and against any and all claims, demands, actions, proceedings, losses, damages, fines, penalties, judgments, settlements, costs and expenses (including reasonable attorneys' fees) (collectively, "Claims") arising out of or in any way connected with:
- your use or misuse of the Service, including any use outside the Intended Scope;
- any breach by you of these Terms, the Acceptable Use Policy, or the Responsible Use page;
- any action taken against you, your accounts, your IP address or your devices by chess.com or any other Third-Party Platform;
- your violation of any law, regulation, contract, or third-party right (including chess.com's Fair Play Policy or Terms of Service);
- any content or information you submit to or through the Service;
- any dispute between you and any other user or third party.
The Provider may, at its option, assume the exclusive defence and control of any matter for which you are required to indemnify, in which case you agree to cooperate at your expense.
8. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Service and the Software are provided "AS IS", "AS AVAILABLE", AND "WITH ALL FAULTS", without warranty of any kind, whether express, implied, statutory or otherwise. The Provider expressly disclaims all warranties, including without limitation warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, and uninterrupted operation.
Without limiting the foregoing, the Provider does not warrant that:
- the Service will be uninterrupted, secure, error-free, or free from harmful components;
- the Software will avoid detection by chess.com or any Third-Party Platform, or that any "anti-ban" feature will succeed in any specific case;
- the Service or its results will meet your expectations or requirements;
- any chess.com account, proxy IP, or other resource provided will remain available for any specific period;
- the Software is suitable, lawful, or safe for use against human opponents.
Some jurisdictions do not allow the disclaimer of certain warranties; in those jurisdictions the foregoing disclaimers apply only to the maximum extent permitted by such law.
9. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Provider shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, including without limitation damages for loss of profits, revenue, goodwill, data, use, savings, or other intangibles, arising out of or in connection with the Service, even if the Provider has been advised of the possibility of such damages.
- The Provider shall not be liable for any chess.com action against you or your accounts, including without limitation account bans, account closures, ELO loss, loss of titles, withholding of prize money, loss of premium-membership status, or reputational damage; you acknowledge that such risks are inherent in your interaction with chess.com and are independent of the Provider.
- The Provider shall not be liable for the actions or inaction of any third party, including without limitation Stripe, NOWPayments, IPRoyal, Discord, Supabase, hosting providers, internet service providers, payment-card networks, or governmental authorities.
- The Provider's total aggregate liability for all Claims arising out of or related to the Service or these Terms, regardless of the form of action and whether based on contract, tort (including negligence), strict liability or otherwise, shall not exceed the lesser of (a) the amount actually paid by you to the Provider during the twelve (12) months immediately preceding the event giving rise to the Claim, or (b) one hundred euros (€100.00).
Mandatory law. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited by Dutch or applicable EU law, in particular liability for fraud, gross negligence, intentional misconduct, or death or personal injury caused by negligence.
10. Subscriptions & Billing
Recurring subscriptions auto-renew at the end of each billing cycle until cancelled. You can cancel anytime in your dashboard or via the Stripe customer portal; cancellation takes effect at the end of the current billing period. We do not pro-rate refunds for partial periods, except where required by mandatory law.
You authorise the Provider (and our payment processors) to charge your selected payment method for all Fees due, including renewals, taxes and any applicable fees. Failed payments may result in suspension of the Service after a grace period.
Prices are in EUR and inclusive of VAT where applicable. The Provider may change prices for future billing periods on at least thirty (30) days' notice; you may cancel before the new price takes effect.
11. Refund Policy & 14-Day Right of Withdrawal
EU consumers normally have a fourteen (14) day right of withdrawal under Directive 2011/83/EU. For the Service this right is waived the moment performance begins (e.g. when your license key is issued, your proxy is provisioned, or your chess.com burner account is created), pursuant to art. 16(m) of that Directive (digital content supplied other than on a tangible medium, where performance has begun with the consumer's prior express consent and acknowledgment that they thereby lose their right of withdrawal). You give that consent at checkout via the Stripe consent checkbox.
Beyond the statutory waiver:
- Discretionary 7-day money-back guarantee: refunds may be granted within 7 days of purchase at the Provider's discretion, except in cases of confirmed misuse, breach of these Terms, or use outside the Intended Scope (including but not limited to bans incurred during human play).
- Defective service: if the Service is materially defective, contact support for a manual review. We will refund pro-rata in genuine cases.
- Crypto payments (NOWPayments): non-refundable by nature; payments cannot be reversed once confirmed on-chain.
- Subscription cancellation: stops future billing; already-billed periods are not refunded.
12. Lifetime IP Fair-Use (12 months)
Lifetime plans that include a bundled IPRoyal residential proxy (for example the Lifetime Multi bundle, and legacy Lifetime purchases that shipped with a proxy) include that proxy for 12 months from purchase. After that period the proxy is no longer included; your software license remains valid indefinitely, but you bring your own proxy or pay IPRoyal directly (~€1.80/month). Software-only Lifetime plans do not include a proxy. This rule is reflected in the dashboard and you are notified 30 days before expiry.
13. Termination & Suspension
The Provider may suspend or terminate your access to the Service, with or without notice, if you breach these Terms (including the Acceptable Use Policy), if any payment is overdue, if continued provision of the Service exposes the Provider to legal or operational risk, or as required by law.
You may terminate your subscription at any time as described in Section 10. Upon termination: (i) your license is revoked; (ii) you must stop using the Software and destroy all copies; (iii) Sections 5–9, 14, 16 and 17 survive termination.
14. Force Majeure
The Provider is not liable for any failure or delay in performance caused by events beyond its reasonable control, including without limitation acts of God, natural disasters, war, terrorism, riots, civil unrest, governmental action, sanctions, changes in law or regulation, labour disputes, internet or telecommunications failures, denial-of-service attacks, third-party platform changes (including changes to chess.com's policies, anti-cheat systems or APIs), payment-processor actions, and infrastructure outages.
15. Changes to Terms
The Provider may amend these Terms from time to time. Material changes will be communicated by posting the updated Terms on chesscheats.com with a revised "Last updated" date and, where reasonably practicable, by email or dashboard notice at least thirty (30) days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service before the effective date and may cancel your subscription.
16. Governing Law & Dispute Resolution
These Terms and any dispute arising out of or in connection with them or the Service are governed by the laws of the Netherlands, excluding its conflict-of-laws rules and excluding the United Nations Convention on Contracts for the International Sale of Goods.
Mandatory negotiation. Before initiating any formal dispute, the parties shall attempt to resolve any dispute amicably by contacting support and providing a written description of the dispute. The Provider will respond within thirty (30) days.
Arbitration. If amicable resolution is not reached within sixty (60) days, any dispute shall be finally resolved by arbitration administered by the Netherlands Arbitration Institute (NAI) in accordance with its Arbitration Rules. The seat of the arbitration shall be Amsterdam, the Netherlands. The language of the arbitration shall be English. The number of arbitrators shall be one. The decision of the arbitrator shall be final and binding.
Consumer rights. If you are an EU consumer and mandatory consumer-protection law of your country of residence grants you a right to bring proceedings in your home courts that cannot be excluded by these Terms, that right is preserved. Otherwise, you and the Provider waive any right to have a dispute heard by a national court (subject to the arbitration agreement above) and waive any right to participate in a class, collective, or representative action.

17. General Provisions
- Entire agreement. These Terms, together with the Privacy Policy, the Responsible Use page, and any plan-specific terms presented at purchase, constitute the entire agreement between you and the Provider regarding the Service and supersede all prior agreements on the subject.
- Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and the invalid provision will be reformed only to the extent necessary to make it enforceable while preserving the parties' intent.
- No waiver. A failure or delay by the Provider to enforce any right under these Terms is not a waiver of that right.
- Assignment. You may not assign or transfer these Terms or your account without the Provider's prior written consent. The Provider may assign these Terms in connection with a merger, acquisition, reorganisation or sale of substantially all assets.
- No partnership. Nothing in these Terms creates an agency, partnership, joint venture or employment relationship between you and the Provider.
- Notices. The Provider may give notice via email, dashboard message, or website posting; you must give notice via the contact form.
- Language. The English version of these Terms is the binding version. Translations are provided for convenience only.
- No third-party beneficiaries. These Terms do not create rights for any person other than you and the Provider.
